Good morning,
I would like to make a request under the Freedom of Information Act please. I would like to see a copy of all Extenuating Circumstances application forms submitted to the SHA's director of performance or their delegate, along with any or all supporting evidence since the beginning of January 2010. This will be requests from non-Foundation Trusts which the SHA has to consider before passing the form onto the Care Quality Commssion. Foundation Trusts submit directly to the CQC.

I refer to your email requesting information in respect of Extenuating Circumstances application forms submitted to NHS East Midlands.
I can confirm in accordance with S.1 (1) of the Freedom of Information Act 2000 (FOIA) that we do not hold any of the information that you have requested.
The Care Quality Commission (CQC) has a number of deadlines for receipt of the forms in question dependent on the different phases for the release of data. The dates can be found on the CQC website http://www.cqc.org.uk/. The deadlines for Strategic Health Authorities to submit the Extenuating Circumstances forms are 15 July for phase 1 and 12 August for phases 2 + 3.
