Thank you for your detailed response to my questions. I would like to ask 4 brief follow up questions.
1. Of the 33 reviews that had been determined (as at 31 March 2010) by the SHA’s Independent Review Panel, how many related to requests for reviews made to the SHA after 1 October 2007?
2. Of the number referred to in the answer to 1 above how many of the decisions on eligibility for Continuing Care being reviewed by the SHA’s Independent Review Panel were made after 1 October 2007?
3. Of the number referred to in the answer to 2 above, how many of the decisions on eligibility for Continuing Care made by the SHA’s Independent Review Panel were carried out under the Continuing Care (National Health Service Responsibilities) Directions 2004 and /or the Continuing Care (National Health Service Responsibilities) Modification Directions 2006?
4. Of the number referred to in 2 above how many of the decisions on eligibility for Continuing Care being reviewed by the SHA’s Independent Review Panel were carried out under the NHS Continuing HealthCare (Responsibilities) Directions 2007.
Our Response
I refer to your email requesting further information in respect of NHS East Midlands’ Continuing Care Independent Review Process.
I can confirm in accordance with S.1 (1) of the Freedom of Information Act 2000 (FOIA) that we do hold the information that you have requested.
I will address each of your queries in turn:-
1. Of the 33 reviews that had been determined (as at 31 March 2010) by the SHA’s Independent Review Panel, how many related to requests for reviews made to the SHA after 1 October 2007?
NHS East Midlands received all requests for reviews of Retrospective Reassessment cases after 1 October 2007 (Please note that there were 32 reviews not 33).
2. Of the number referred to in the answer to 1 above how many of the decisions on eligibility for Continuing Care being reviewed by the SHA’s Independent Review Panel were made after 1 October 2007?
All the decisions being reviewed by the Independent Review Panel related to decisions made by the Retrospective Reassessment Panel after 1 October 2007 (but were in relation to retrospective cases where the period of enquiry predated 1 October 2007).
3. Of the number referred to in the answer to 2 above, how many of the decisions on eligibility for Continuing Care made by the SHA’s Independent Review Panel were carried out under the Continuing Care (National Health Service Responsibilities) Directions 2004 and /or the Continuing Care (National Health Service Responsibilities) Modification Directions 2006?
All the decisions referred to in 2 were carried out by the Independent Review Panel under the 2004 and /or 2006 Directions.
4. Of the number referred to in 2 above how many of the decisions on eligibility for Continuing Care being reviewed by the SHA’s Independent Review Panel were carried out under the NHS Continuing HealthCare (Responsibilities) Directions 2007.
None of the decisions of the Retrospective Reassessment Panel which were reviewed by the Independent Review Panel were carried out under the 2007 Directions.
