In relation to the 2009 calendar year (Jan 1 – Dec 31) on how many occasions have you recorded an incident where personal data either held by you or organisations who report to you (GPs, PCTs, Acute Trusts) was either lost, stolen or mislaid?
For each incident please give (i) the organisation that was responsible for holding the information, (ii) how many people’s data was affected, (iii) brief circumstances relating to how the data was lost, stolen or mislaid, and (iv) if all, none or a proportion of the individuals whose data went missing were informed of the incident.
Our Response
I refer to your email requesting information in respect of data loss.
I can confirm in accordance with S.1 (1) of the Freedom of Information Act 2000 (FOIA) that we do hold the information that you have requested.
However, we are of the opinion that the exemption offered to us under Section 21 of the FOIA is engaged in this instance. As you will be aware, Section 21 refers to information that is already reasonably accessible to the applicant.
Nevertheless, Section 16 of the FOIA places a duty on us to provide help and assistance to the applicant and I have therefore attached the relevant link to this information which is published on our website.
