we are interested in the progress that some PCTs are making to move NHS services into a social enterprise. It is our understanding that all 'Rights to Request' are reported by the PCT's Boards to the SHA.
Therefore can you please supply us with the details of all the applications that you have been notified of to date and details as to the business plan and names of applicants?

I refer to your request for information in respect of ‘The Right to Request’.
I can confirm in accordance with S.1 (1) of the Freedom of Information Act 2000 (FOIA) that we do hold the information that you have requested.
However, we are of the opinion that the exemption available to us under Section 21 of the FOIA is engaged in this instance. The section 21 exemption relates to information already reasonably accessible to the applicant and I understand that Avril Johns, Director of Strategy and System Development, provided you with responses to your questions by letter on 27 January.
Section 21 is an ‘absolute’ exemption meaning that we do not need to apply the public interest test in determining our response.
