I refer to your email requesting blood test results from 1998.
I can confirm in accordance with S.1 (1) of the Freedom of Information Act 2000 (FOIA) that we do not hold the information that you have requested. I should point out that the role of NHS East Midlands as a Strategic health Authority (SHA) is to relay and explain national policy, set direction and support and develop all NHS Trust bodies (Primary Care Trusts and NHS Trusts providing acute, mental health and ambulance services). As such we have no direct clinical responsibilities and we do not hold blood test results for individuals or larger groups.
However, it is not clear from your request what information you are asking for or to who it relates. Your request would be exempt from provision under the FOIA as section 40 (1) exempts personal information about the applicant. This is because a right of access to personal information exists under the Data Protection Act 1998, which is a separate access regime.
In order to obtain your own personal data (ie blood test results from 1998) you must put your request in writing to the relevant data controller as stated in Section 7 (2) (a) of the Data Protection Act 1998. In order to ensure that your request satisfies the data controller that you are who you say you are, you could be asked to provide a fee and proof of identification.
It is unlikely that personal information relating to third parties would be released to you under any of the access regimes.
