Enquiry Details: Please will you supply me with an electronic copy of the mb health alert submitted by the SHA in relation to publication of the report from the Care Quality Commission and warning notice issued to East Midlands Ambulance.

I refer to your email requesting a copy of the NHS East Midlands MB Health Alert in relation to publication of the report from the Care Quality Commission and warning notice issued to East Midlands Ambulance Services NHS Trust.
I can confirm in accordance with S.1 (1) of the Freedom of Information Act 2000 (FOIA) that we do hold the information that you have requested which I have attached as a pdf document.
You will note that I have removed the out of hours telephone numbers for both NHS East Midlands and the East Midlands Ambulance Services NHS Trust from the attachment as this relates to information provided in confidence, numbers which are not disclosed to the public. We are therefore of the opinion that Section 41 of the FOIA is engaged in this instance. Section 41 relates to information whose disclosure would be a breach of confidence at common law. This exemption is classed as ‘absolute’ meaning that there is no obligation on us to consider the public interest test in this instance.
